I don't think so...today I got the Card Production Ordered email , after attending the interview at a local office a month ago. My PD is 06/30/2004 . You should be getting it soon, good luck.

If they are paying u for the 5 month gap, its not termination you are still on their pay rolls so u will have no problem coz u are gettin pay check for the 5 months. No need for LOA too if you have pay stubs

In other words there isn't really any harm in using the travel doc so long as you don't use the EAD and maintain h1/h4. This is good to know. However, I am still thinking about technical details like whether to surrender the I94 or not on the way out and whether I should show both H1/H4 and travel doc to the IO at POE.
When i asked my lawyer, they said that this is not true. You can come back with travel documents and still continue on h1/h4. You lose your h1/h4 status only if you use your ead card.

where can I find these codes related to my present(per GC) and other jobs i'm looking around to fit in my original job designation and responsibilties?
Like the intiator in this thread came up with some job/occupation codes which starts with 15 - XXXX ..he talked abt getting it from the approved Labor
I have access to my approved Labor and I-140...but where can I find these codes in those documents?

I'm not sure what made you decide for CP. There maybe valid reasons or you maybe misguided.
I have heard some people use the CP route thinking that once the dates get current, they will get Green Card faster than AOS route. Some people use it as a back-up. But I am not sure what made you opt for this if you knew you will deny yourself EAD and AP benefits.

I assume there could be 10 to 15% CP filers out of total, say, 400K pending 485 cases. So, between 40 to 50k CP filers. Not sure how many out of this would be India/China. Is this number not big enough for asking for some admin fix?

If DOS/USCIS know very well that this retrogression is gonna be there for the next 5-10 years and EB3 I have to wait for 10-15 years, does it not make sense to ask for a relief like EAD for CP filers?

I just received my H1B starting Oct 1st. My desi (cheap) employer first decided to not pay me till Oct 15th because I didn't have a SSN. Then after my SSN came they decided that they wanted to reduce my salary, the reason being that the company's economic situation has changed since Jan filing.
I am concerned because I am going for my visa stamping in March and the last thing I want is to be out of status! When I mentioned this to my boss his answer was -- We will give you a letter stating that you are working reduced number of hours, and we cannot afford the salary promised on I-129.
Can somebody help? What are my options? I was on H4 and moved to H1. I am really frustrated with their attitude and in this economy it is really hard to find a job.
Any help would be great.

I'm assuming you are Indian like most of us on this site. remember THIS country would be in big trouble with Indians working in all kinds of institutions working in the sciences and IT. The whole country would go down the pan. I work for an IT recruitment firm, 80% of our employees that are out on assignment are Indian and i think the govenment knows that..

Yes i did see a LUD on the uscis website for my 485 a couple of weeks back.
So i guess the LUD stuff still works irrespective of the "chimps" using "champs".

If you filed your I-485 in July, 2007 with the knowledge and consent of Company A, you are in order as GC is for future employment. It would appear you did so since they did not withdraw the I-140.
Having said, the only proper course of action is for you to go back to work for Company A after you obtain your GC.
If you would like to work for Company B after GC, you would have to file a change of employer right now (using AC21 provisions). Alternatively you may interfile the approved I-140 from employer B with your current application. You are entitled to keep the priority date on the I-140 of employer A so you should not be affected negatively.
If your lawyer is saying you could continue to work for employer B after GC without doing anything at this time, I would suggest you talk to another immigration attorney to hear a second opinion.

hi i got an RFE for ability to pay, my pay was 55K ( it had to be 66K ) last year 2006 on my W2, my RFE asked me on ability to pay where my labor was approved on feb2006, so i had to show that my employer has the ability to pay till date.
So my lawyer, wrote a simple letter to the USCIS, that my current paystubs shoed that my employer is paying me the salary ( i have it on 66K this year 2007 ) also he sent my employers tax records, he has a good profit, and then my 2 recent paystubes & my last years w2

Did you change your address. Sometimes they send denial at the old address. Also you need a lawyer now with the print out of the page where it lists pending. This forum cant help with this situation as an appeal is needed in your case.

almost 120 days...
All PERMS are being processed at Atlanta! hence the pile up!
My friend applied for PERM on April 1st and got approved yesterday.
Just wanted to let the people know who have their perm pending, so they can calculate processing dates.

I had LUD on I-140 on 11/25 as well. 140 was approved late last year.
